These Terms of Service (“Terms”) govern your use of the HireDay platform and website (collectively, the “Service”) operated by HireDay, Inc. (“HireDay,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Accounts and Organizations
To use HireDay, an authorized representative of your organization must create an account. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately at hello@hireday.io if you suspect unauthorized access.
Each organization gets an isolated workspace. You are responsible for the accuracy of the data your organization enters into HireDay, including employee and new hire information.
2. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Upload or transmit malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Scrape, reverse-engineer, or copy any part of the Service without permission
- Use the Service to process data belonging to individuals without appropriate authorization
- Resell or sublicense access to the Service to third parties
3. Subscription and Payment
HireDay is currently in early access. Pricing terms will be provided before any paid subscription begins. By requesting early access, you are not committing to a paid plan.
Once paid plans are available, subscriptions are billed in advance on a monthly or annual cycle and renew automatically until cancelled.
3.1 Cancelling
You can cancel at any time from your billing settings, without contacting us and without explaining why. Cancelling stops all future charges. Your paid features remain available until the end of the period you have already paid for, and your account then returns to the free plan — it is not closed, and your data is not deleted.
3.2 Refunds
Monthly plans. Cancel whenever you like. We do not refund part of a month, because you keep full access until that month ends.
Annual plans — 30 days, no questions asked. If you are not happy with HireDay, email us within 30 days of an annual charge and we will refund it in full. You do not have to tell us why. This applies to every annual charge, including automatic renewals, not only your first one. After 30 days an annual term is non-refundable, and you keep access until the term ends.
Renewal notice. We email account administrators at least 7 days before an annual plan renews, stating the amount and the date, so that a renewal is never a surprise.
Refunds are returned to the original payment method and typically take 5–10 business days to appear, depending on your bank.
Adding seats mid-period is charged at the time you add them. Removing seats or moving to a cheaper plan takes effect at your next renewal and is not refunded for the current period.
Nothing in this section limits any right to a refund that you have under applicable law.
4. Your Data
You retain ownership of all data your organization uploads to HireDay (“Customer Data”). You grant HireDay a limited license to store, process, and display your Customer Data solely to provide the Service.
HireDay will not access your Customer Data except to provide and improve the Service, respond to support requests, or as required by law. We will not share your Customer Data with other organizations.
5. Intellectual Property
HireDay and its logos, platform software, and documentation are owned by HireDay, Inc. and protected by intellectual property laws. These Terms do not grant you any rights to HireDay’s intellectual property beyond the right to use the Service as described here.
6. Privacy
Our Privacy Policy describes how we collect and handle personal data. By using the Service, you agree to the Privacy Policy.
7. Third-Party Integrations
The Service integrates with third-party identity providers such as Okta. Your use of those services is governed by their own terms and privacy policies. HireDay is not responsible for the practices of third-party services.
8. Uptime and Support
We aim to keep HireDay available and operational, but we do not guarantee any specific uptime level during early access. We will make reasonable efforts to notify you of planned maintenance or significant outages.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HIREDAY DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIREDAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL HIREDAY’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO HIREDAY IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Termination
You may cancel a paid subscription at any time from your billing settings (see section 3.1), and you may close your account entirely by contacting us. We may suspend or terminate your access if you materially breach these Terms and fail to cure the breach within 14 days of notice.
Cancelling a paid subscription (section 3.1) is not termination: your account continues on the free plan and your Customer Data is retained.
If you ask us to close your account, or if we terminate it for breach, your right to use the Service ends and we will delete your Customer Data within 90 days of that point, unless we are required by law to retain it longer. Export anything you want to keep before asking us to close the account; if you need longer, tell us and we will wait.
12. Changes to These Terms
We may update these Terms as the Service evolves. We will notify account administrators by email of material changes at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Delaware.
